Rare: Ruling on Mikveh-Related Topics by the Gaon Rabbi Avraham Wexler Av Beit Din of Schwabach, to his Son-in-Law

Lengthy letter from the great gaon Rabbi Avraham b"r David Wexler to his son-in-law Rabbi Yosef Aryeh. Schwabach, 1834. Letters from him are very rare.

The letter deals with a fascinating question in the halachahs of mikvehs: Is it permitted to cut down a fruit tree to build a mikveh taharah in its place? Rabbi Avraham was a talmid-chaver of the gaon rabbi Mendel Kargoi, who was very involved with the halachahs of taharah and mikvehs. Rabbi Avraham reminds him in this letter: "I write these kinds of things to my close friend the great rabbi Maharma"k of Furth ..."

The second part of the letter deals with a halachic question in the halachahs of mourning, in which Rabbi Avraham decides against Rabbi Mendel's opinion, and in favor of that of the Noda BiYehudah. Rabbi Avraham writes about his psak, that "I am not saying this on my own, rather from the rabbi, the great gaon Rabbi Yechezkel Landau, author of Noda BiYehudah, who was a great rabbi. His instructions [!] were written in the above-mentioned sefer, and this is what he ruled as practical halachah. So the words of the rabbi Rama"k can be disregarded ..."
