Lengthy, Unique Psak Din Handwritten by Rabbi Shmuel Heller of Safed
Extremely lengthy and unique psak din [close to 1000 words]. Entirely handwritten and signed by the famous rabbi of Safed, the sacred gaon Rabbi Shmuel Heller, regarding the concept of bar metzra as it pertains to a non-Jew. [Safed], 1874. Including the inquiry, which is also handwritten.
This ruling deals with an ancient courtyard bought by Rabbi Moshe Chara"g [Zeiger], grandchild of a Safed activist, from a non-Jew. However, some of the corner of the courtyard was not included in the sale, and while R' Moshe Chara"g wanted to purchase it, others pursued the non-Jew to purchase it, with the claim that the halachah of bar metzra does not apply to a non-Jew!
In this lengthy psak din, which covers about four pages, Rabbi Heller deliberates the halachahs of bar metzra and ani hamehapech b'charara and related concepts. He concludes "and one who examines the words of the poskim will explicitly see that with respect to ani hamehapech b'charara ... that regarding pissuk damim ... for a non-Jew, there is not the status of ani hamehapech b'charara, but with respect to bar metzra ... it is clear that someone who pursues the owner in competition with Rabbi Chara"g is a rasha ... and anyone who heeds us will live in peace and tranquility."
