 AUCTIONEER: The bidding advances shall be regulated by the auctioneer and shall be at his discretion. The auctioneer reserves the right to determine the opening bid / minimum bid on any lot. The auctioneer reserves the right to pass / no sale any lot. The auctioneer may reject nominal bids, small opening bids or very nominal advances made with the purpose of disparaging an item. Once a lot has been passed and not sold it will not be re-offered until a later sale. Items which are not reserved are sold at the auctioneer’s discretion. The auctioneer has the right to refuse any bid. The Auctioneer reserves the right to execute absentee bids on behalf of clients and vendors, but shall not be liable for errors or omissions in executing instructions to bid. The auctioneer acts as agent only, and shall not be liable for any default of the purchaser or vendor.

BID INCREMENTS: All bids, including absentee and Internet must be on increment. The auctioneer reserves the right to deviate from the established increment at their discretion. Bid Increments are as follows:

DISPUTE BETWEEN BIDDERS or TIE BID: In the event of any dispute between bidders or a tie bid between bidders, the auctioneer has sole and final discretion to recognize and award the winning bid. The auctioneer’s sole resolution of the dispute or tie bid is final and binding on all bidders and all bidding mediums.

CONSIGNORS: Consignors are NOT permitted to bid on their own items.  By placing your item up for auction, you have agreed to sell. We cannot discuss payment on the day of the auction. Consignors may only be paid proceeds on items for which payment has been received from a buyer.


GENERAL TERMS & INFORMATION: Employees and associates of Brewton Auction & Estate Sales are permitted to purchase lots at competitive bidding under the same terms, rules and regulations as the general public. By bidding at this auction whether in person or by agent, absentee bid, telephone bid or other means, the buyer or bidder agrees that the contract created by these conditions of sale is made and performed IAW the rules and laws of the State, County and City in which the auction is taking place. The Auction Company has sole discretion on whether to approve an individual for bidding. Auction Company has sole discretion to decline an individual’s bidder application for any reason. Auction company has sole discretion to nullify a sale for any reason.

INTERNET BIDDING: Bidders are able to bid via one of our Internet Auction Platforms. The online bidding platform will incrementally (in accordance with standard bid increments) execute bids on bidder’s behalf until the bid is either successful or exhausted. We employ a soft close format. This means once a bid is posted on an item in an online only auction the time is reset 15 seconds to allow for new bids.  Internet bidders may be required to agree to additional terms established by the Internet bidding venue. Internet bidders may be subject to a different Buyer’s Premium.

1. Acceptance of Terms and Conditions: By participating in our auctions, whether through the acquisition of a bidder card or a bidder number, you acknowledge and agree to be bound by the following terms and conditions. Any notices, whether posted or oral, during the sale, are also considered part of this agreement.

2. Item Descriptions: All items are sold "as is, where is." We make no guarantees or warranties regarding the items sold. The descriptions provided in the catalog are for reference and are based on our opinion. We acknowledge that errors may occur in these descriptions. We strongly recommend inspecting items personally or seeking the opinion of a qualified expert. No refunds or returns will be accepted.

3. Firearms Disclaimer: Regarding firearms, we make no warranties or representations concerning their operation, condition, safety, or reliability. The use of any purchased firearm or ammunition is entirely at the user's risk. We recommend having all firearms inspected by a competent gunsmith. We disclaim any liability for accidents, injuries, or damages resulting from the storage or use of firearms or ammunition.

4. Wire Transfers are a $30 flat fee. It is your responsibility to contact the valid FFL provider of your choice for the transfer.

5. Compliance with Laws: It is your responsibility to understand and comply with local, state, and federal laws regarding the items you bid on. No refunds or returns will be issued for items that are not allowed in your jurisdiction. All sales are final.

6. Inspection and Responsibility: Bidders who are not present at the live auction understand that they may not have the opportunity to inspect items in person. It is your responsibility to determine the condition, age, authenticity, and value of items before bidding.

7. Internet Bidding: We offer internet bidding as a service, but we do not guarantee its functionality. We are not responsible for missed bids due to technical issues. 

8. Auction House's Right: We reserve the right to withdraw or re-catalog items in the auction.

9. Payment:  3% discount for all non-electronic payments.   All sales are for cash, wire transfer( Wire Transfers are a $30 flat fee) , check with pre-approval, Visa, MasterCard, Discover Card, or Debit Card. A Credit Card processing fee of 3% will be added to all credit card payments. There will be a $50.00 fee for returned checks or chargebacks.

10. Pickup and Storage: Locals, Items must be paid for and picked up on scheduled pickup days, unless prior arrangements have been made.

11. Shipping: We use FedEx and U.S.P.S. for shipping. Shipping charges include a box fee and required insurance. Small, crated items will be quoted before shipping. We provide in-house shipping and work diligently to keep costs to a minimum.

12. Firearms and Legal Requirements: All firearms must comply with local, federal, and state laws. Buyers must have their dealer supply their Federal Firearms License (FFL) before shipping. It is your responsibility to know and comply with your state and local firearm requirements. Have your dealer email their FFL to JAYSPAWNBREWTON@YAHOO.COM and make sure they include your name on the email.

13. Liability and Safety: By participating in this auction, you release the seller and Brewton Auction and its affiliates from any liability related to the purchase, ownership, possession, use, or misuse of items. All firearms should be inspected by a certified gunsmith before use.

14. Miscellaneous:

* Sales Tax is payable by buyers liable for tax.

*All bids are per the catalog number, and all items will be sold in numerical order.

*We reserve the right to refuse any bid not believed to be in good faith.

15. Finality: All sales are final, and there are no refunds or exceptions. The acceptance of a bid constitutes a legal and binding contract.
